The following constitute the Mountain View Wesleyan Church Business Directory (“Business Directory”) Terms of Use and Disclaimers (“Terms”), and are subject to change at any time by Mountain View Wesleyan Church, at its sole discretion. Business Owners who elect to create links to the Business Directory, by that election, agree to all of these Terms.
The Business Directory’s purpose is to bring local consumers and local business together.
The Mountain View Wesleyan Church Business Directory will not knowingly provide to, or accept from, any Business Owner, web pages that contain, or the links to websites that contain anything illegal, pornographic, degrading or abusive to another person, including, but not limited to, gambling, hate-group propaganda; inappropriate material, or provide links to such material that may provide material that is inappropriate or offensive, including, but not limited to, expressions of bigotry, racism, hatred, or profanity; that may constitute harassment, is threatening or potentially libelous, or for promoting or providing instructional information about illegal or inappropriate activities, or promoting physical or other harm or injury against any individual, group, race or country.
Business Owners agree to provide links to and advertise products or services that may only be used for lawful and appropriate purposes. Providing or solicitation of any material that violate the laws of the United States Federal, State, Local or other policies or laws that may apply in this jurisdiction or your local area is prohibited. Business Owners also agree to abide by the policies of Mountain View Wesleyan Church and any host server that the Mountain View Wesleyan Church may utilize. No material may be published on web pages provided by the Mountain View Wesleyan Church, or linked though, or to, that would or could be considered indecent or adult material.
If any dispute or question occurs, Business Owners may request a consultation with the Mountain View Wesleyan Church senior pastor before seeking any other relief per 1 Corinthians 6:1-8. In any event, Business Owners bear the sole risk of any liability relating to their use of the Business Directory. MOUNTAIN VIEW WESELYAN IS NOT BE RESPONSIBLE TO BUSINESS OWNERS OR ANY THIRD PARTIES FOR ANY DIRECT OR INDIRECT, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES YOU MAY INCUR IN CONNECTION WITH THE WEBSITE OR THE SYSTEM, OTHER’S USE THEREOF OR ANY OF THE DATA OR OTHER MATERIALS TRANSMITTED THROUGH OR RESIDING ON THE SYSTEM, REGARDLESS OF THE TYPE OF CLAIM OR THE NATURE OF THE CAUSE OF ACTION.
Mountain View Wesleyan Church WILL NOT be responsible for nor may be held liable for any damages or other claims which may in any way be related to Business Owners’ links to or through the Business Directory. Business Owners are utilizing the Business Directory at their own risk. Any correspondence or business dealings with, or participation in promotions of, Business Owners found on or through the Business Directory website, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings are between those who elect to engage services or purchase products. The Business Directory is only a conduit, and not responsible or liable for transactions. These actions are solely between the consumer and the Business Owners. Mountain View Wesleyan Church shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such business owners on COLORADOSPRINGSCHURCH.ORG.
Mountain View Wesleyan Church respects the intellectual property of others, and requests that Business Owners do the same. If a Business Owner believes that its work has been copied in a way that may constitute copyright infringement or other inappropriate use, the Business Owner should contact the other party immediately, with, for example, the following information to address and attempt to rectify the situation:
1.) An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.
2.) A description of the copyrighted work that you claim has been infringed.
3.) A description of where the material that you claim is infringing is located on the site.
4.) Your address, telephone number, and email address.
5.) A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
6.) A statement by you, made under penalty of perjury, that the above information is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
Mountain View Wesleyan Church is not responsible for the content or the copying or use by others of Business Owners’ information or intellectual property information.
Mountain View Wesleyan Church makes no representation or in any way guarantees the availability of its Web site or of the products and/or services available on the Business Owners’ pages or the Business Owners’ linked Websites. The opinions and views expressed by Business Owners do not reflect and may not be assumed to be those of the Mountain View Wesleyan Church.
Business Owners may change or discontinue their hyperlink at any time. In its sole discretion, considering the purpose of this directory and the missions of the Mountain View Wesleyan Church, the Business Directory reserves the right to modify, suspend or terminate access to the hyperlink service, any link (or any part thereof) in the Business Directory at any time for any reason without notice or refund, including the right to require Business Owners to change their hyperlink destination. Failure of Business Owners to provide an active hyperlink destination will result in removal of hyperlink from the directory without notice or refund. The Business Directory also reserves the right to delete all program and data files associated with Business Owners account and/or other information have on Business Directory’s system.
If a claim is brought, Business Owners agree to and shall defend and indemnify Mountain View Wesleyan Church and hold it harmless from and against any and all claims, proceedings, damages, injuries, liabilities, losses, costs and expenses (including attorneys' fees), relating to the Business Directory and Business Owners’ links and hyperlinks, made by other users, subscribers or third parties, regardless of the type of claim or the nature of the cause of action.
THE BUSINESS DIRECTORY IS PROVIDED "AS IS". THERE ARE NO WARRANTIES, EXPRESS OR IMPLIED, AS TO THE MERCHANTABILITY, FITNESS FOR A PARTICULAR USE OR PURPOSE, TITLE, NON-INFRINGEMENT OR ANY OTHER WARRANTY, CONDITION, GUARANTY, OR REPRESENTATION, WHETHER ORAL, IN WRITING OR IN ELECTRONIC FORM, INCLUDING BUT NOT LIMITED TO THE ACCURACY OR COMPLETENESS OF ANY INFORMATION CONTAINED THEREIN OR PROVIDED BY THE BUSINESS DIRECTORY.
You agree that this Agreement shall for all purposes be governed by and construed in accordance with the laws of the State of Colorado, and that any action arising out of this Agreement shall be litigated and enforced under the laws of the State of Colorado. In addition, you agree to submit to the jurisdiction of the courts of the State of Colorado, and that any legal action pursued by you shall be within the exclusive jurisdiction of the courts of the State of Colorado.
Mountain View Wesleyan Church reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Business Directory (or any part thereof) with or without notice. Business Owners agree that Mountain View Wesleyan Church shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Business Directory.
